GROSS, "WTO government procurement rules and the local dynamics of procurement policies : a Malaysian case study", in : European Journal of International Law, 17 (2006), pp. 151-186 The article examines efforts to create binding international rules regulating public procurement and considers the failure to reach a WTO agreement on transparency in government procurement. The focus of the discussion is the approach taken by Malaysia to these international procurement rules and to the negotiation of an agreement on transparency. Rules governing public procurement directly implicate fundamental arrangements of authority amongst and between different parts of government, its citizens and non-citizens. At the same time, the rules touch upon areas that are particularly sensitive for some developing countries. Many governments, like Malaysia, use preferences in public procurement to accomplish important redistributive and developmental goals. Malaysia has, therefore, been forceful in resisting being bound by international public procurement rules, and has played an important role in defeating the proposed agreement on transparency. We suggest that our case study has implications beyond procurement. The development of international public procurement rules appears to be guided by many of the same values that guide the broader effort to create a global administrative law. This case study, therefore, has implications for the broader exploration of these efforts to develop a global administrative law, in particular the relationship between such efforts and the interests of developing countries. | |

PING, WANG, "Coverage of the WTO's Agreement on Government Procurement : challenges of integrating China and other countries with a large state sector into the global trading system", in : Journal of International Economic Law, 10 (2007), pp. 887-920 The WTO's plurilateral Agreement on Government Procurement (GPA) is a significant WTO instrument to develop disciplines regulating government procurement. A recent major review of the GPA has led to a revised text, likely to enter into force in 2007. In the meanwhile, China, a country with a large state sector, has promised to initiate GPA accession negotiations by the end of 2007. The article provides a critical assessment of the extent to which the recent review of the coverage of the GPA has appreciated the characteristics of the government procurement regime of those countries with a large state sector. It is argued that the lack of a principled approach to entity coverage and the ambiguities surrounding the scope of covered procurement are likely to substantially hinder the negotiating process and prevent the optimal outcome of accession negotiations. It is suggested that a formula consisting of basic factors defining the coverage of government procurement disciplines, such as government control and competition, should be employed to address this issue. | |
